1.Acceptance
By using SMARTERPICKS (the "Service") — including this website, our daily picks, our Discord, and any chat or alert features — you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the Service.
2.What We Provide
The Service is an analysis and information service. We publish daily betting picks, reasoning, and historical results across major US sports leagues. Premium subscribers receive the full daily card, line-movement context, and access to the premium Discord.
We are not a sportsbook. We do not accept bets, hold funds, or process wagers. Any betting you do happens through your own account at a licensed sportsbook in a jurisdiction where sports betting is legal.
3.Eligibility
You must be at least 21 years old to use the Service. By using SMARTERPICKS you confirm that you are at least 21, that you reside in a jurisdiction where receiving sports betting analysis is legal, and that any wagers you place are legal where you place them.
It is your responsibility to know and follow the gambling laws in your jurisdiction. We do not solicit bets from anyone in jurisdictions where doing so is unlawful.
4.Subscriptions and Billing
Premium access is sold as a monthly or annual subscription. All payments are processed by Whop (whop.com), which acts as the merchant of record. We do not see, store, or process your payment information.
- Subscriptions auto-renew at the end of each billing period unless cancelled.
- You can cancel anytime through your Whop account, with no fees or runaround.
- Cancelling stops future billing — you keep access until the end of the period you've already paid for.
5.Refunds
We offer a 7-day money-back guarantee for new monthly subscriptions. If the Service isn't for you, email support@smarterpicks.io within seven days of your first charge and we'll refund the subscription fee.
Annual subscriptions are eligible for prorated refunds: cancel and you'll be refunded for the unused portion of your year. Refunds are issued through Whop and typically appear in 5–10 business days.
6.Acceptable Use
You may use the Service for personal, non-commercial purposes. You may not:
- Resell, redistribute, or republish our picks (in any forum, group chat, paid newsletter, or service) without written permission.
- Scrape the site, the Discord, or our APIs in an automated fashion beyond reasonable personal use.
- Share your subscription credentials. One subscription = one user.
- Use the Service to harass other members or violate any law.
Violations may result in immediate termination of your subscription without refund.
7.Account Termination
You can terminate your account at any time by cancelling your subscription on Whop. We can terminate your access if you violate these Terms, abuse the Service, or engage in fraudulent or harmful behavior. We'll generally try to warn you first when the situation allows.
8.No Guarantees
Sports betting involves substantial financial risk. Our picks are analysis and opinion, not guarantees of profit. Past performance does not predict future results. Variance is real — even a strong long-term track record will include losing days, losing weeks, and losing months.
You alone are responsible for any wagers you place and for any losses you incur. Do not bet money you cannot afford to lose.
9.Limitation of Liability
To the maximum extent permitted by law, SMARTERPICKS and its operators are not liable for any losses, damages, or expenses arising from your use of the Service — including but not limited to gambling losses, lost profits, or missed opportunities.
The Service is provided on an "as is" basis. We make no warranties about uptime, accuracy, completeness, or fitness for a particular purpose.
10.Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be communicated through the Service or by email. Continued use after a change constitutes acceptance of the new Terms.
11.Governing Law
These Terms are governed by the laws of the United States and the operator's state of residence. Any disputes will be resolved in the courts of that jurisdiction. Where local consumer protection laws give you stronger rights than these Terms, those laws apply.
